Protection Act:
This act is all about the processing of information, it gives people the rights to view information about somebody but you must handle it within the law.
There are eight main rules within this act:
1) Data must be processed fairly and lawfully
2) Data must not be kept longer than necessary
3) Data must be accurate and where necessary up to date
4) Data must be obtained for a specific purpose and used as such
5) Data must be transferred outside the European Economic area unless that country has a similar level of data protection.
6) Data must not be kept longer than necessary
7) Data must be processed with the rights of the data subject
8) Measures must be in place to prevent unlawful processing of the data, loss of data or accidental damage
If a company holds data about you, you have these rights:
The right to see the data they have about you.
The right to stop them processing the data if its going to cause a problem.
The right to seek compensation for problems caused if the data has been processed un-ethically.
The right to correct or delete in correct data.
The right to stop the processing of the data for direct marketing.
Also companies don't need your acknowledgement to store your data because:
Data will be needed for setting up contracts.
Data is compulsory for attendance records in colleges / schools.
Data will be needed for administering justice.
Data will be collected by the government for public interest.
Some data is registered that you cannot view:
Data that can be used for investigations for crimes
Data that can affect court cases
Data that can affect you TAX
Data that can identify that another person has given consent for the data to be released.
Information commissioner:
The Data Protection act is watched over by an Information Commissioner who is chosen and appointed by the government. The job is to ensure that the Data Protection act is being followed correctly. They are the people who decide how data is collected, organised, stored and also used. If a company wants to process some personal information they are placed on a public register enforced by the law, because it is illegal to process personal information without being on the register.
